The Benton Public Utilities Commission will meet on Monday, February 6th at 6 p.m. The location is the Benton Utilities Electric Department, 1827 Dale Avenue Benton, AR 72015. Audio recordings of the meeting will be available upon request.
The agenda includes several items, one of particular interest that has been in the news with regard to food trucks. The proposed ordinance would require food trucks owners/operators doing business within the city limits of Benton to obtain a $150 food & beverage permit each year and agree to gray waste water disposal requirements. This would be in addition to the privilege license required by the City of Benton, and Advertising & Promotion (A&P) tax on any sales that would go to the City. “AN ORDINANCE AMENDING ORDINANCE 3 OF 2016 AND ORDINANCE 24 OF 2016, ESTABLISHING PROCEDURES FOR PORTABLE FOOD TRUCKS; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Benton adopted certain procedures for the licensing of food trucks in the city; and WHEREAS, it has been determined these procedures should be amended to adopt additional permitting from the Wastewater Conveyance Department regarding grey water discharge. SECTION 1. Prior to obtaining a privilege license allowing vendors to operate within the city, all food truck vendors must pay to obtain an annual Wastewater Conveyance Food/Beverage permit in the amount of $150.00 and sign an agreement (Exhibit “A”) for disposal of gray waste water. This permit is good for one year from the date of purchase. Section 3. Because there is an urgent need to modify the existing procedures regulating food trucks with the city, an emergency is declared and this ordinance shall be in full force and effect from and after its passage.”
