A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF BENTON TO UTILIZE FEDERAL-AID FUNDS FOR THE FOLLOWING CITY PROJECT: Construction of the Newcomb Road Sidewalks
WHEREAS, the Metroplan Board has approved Federal-aid Transportation Alternatives Program funds for the project at the following Federal and City participating ratios:

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BENTON ARKANSAS, THAT:
- SECTION I: The City will participate in accordance with its designated responsibility in this project including maintenance of this project.
- SECTION II: The City Mayor or his designated representative is hereby authorized and directed to execute all appropriate agreements and contracts necessary to expedite the construction of this City project.
- SECTION III: The City pledges its full support and hereby authorizes the Arkansas Department of Transportation to initiate action to implement this project.

ORDINANCE NO. __ OF 2019
AN ORDINANCE AMENDING REFERENCES IN ORDINANCE 45 OF 2007 IDENTIFYING ALL REFERENCES TO PUBLIC WORKS DEPARTMENT TO BE THE CITY OF BENTON STREETS AND DRAINAGE DEPARTMENT (SDD) AND/OR CITY ENGINEER AND FOR ANY APPEALS TO THE PLANNING COMMISSION TO BE TO THE CITY OF BENTON STREETS AND DRAINAGE COMMITTEE; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES
WHEREAS, the City Council of the City of Benton, Arkansas, has an obligation to manage stormwater throughout the city to protect the health and safety of its citizens and adopted Ordinance 45 of 2007 which by public notice and public hearing in 2007, the City of Benton adopted the Little Rock Stormwater and Drainage Manual and all editions hence, to properly manage stormwater and meet federal and state regulations; and
WHEREAS, it has been determined that throughout the adopted Little Rock Stormwater and Drainage Manual there exists references to the Public Works Department and that Appeals should go to the Planning Commission and these references should be clarified as they apply to the City of Benton;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Benton, Arkansas, that:
- SECTION 1: All references within the Little Rock Stormwater and Drainage Manual that refer to the Public Works Department shall be considered the City of Benton Streets and Drainage Department (SDD) and/or the City Engineer;
- SECTION 2: All references within the Little Rock Stormwater and Drainage Manual that refer to the Appeals body being the Planning Commission shall be considered the City of Benton Streets and Drainage Committee,
- SECTION 3: All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed;
- SECTION 4. The City Clerk shall, upon passage and approval of this ordinance, maintain a copy of the text of this Ordinance and the latest update of the Manual for use and examination by the public.
- SECTION 5. The City Council hereby determines that the immediate action to clarify the above references are necessary for the preservation of the public health, safety and welfare and an emergency is hereby declared. This ordinance shall be in full force and effect after its passage and approval.
